SEC Promises to Build a Legal Framework for Cryptocurrencies

The regulator has released a draft proposal for public discussion that would reshape its approach to digital assets and enforcement.

On June 2, the U.S. Securities and Exchange Commission published a draft of its new strategic plan and opened a public comment period through July 2. The document returns the agency to the three core objectives established by Congress more than 90 years ago: protecting investors, maintaining fair markets, and facilitating capital formation.

The Outlook for Digital Assets

The regulator says it plans to finally establish a clear legal framework for digital assets and distributed ledger technologies — one it describes as rational and principles-based. The agency also intends to simplify disclosure requirements, expand access to private markets, and develop new ways for entrepreneurs and small businesses to raise capital.

SEC Chairman Paul Atkins pledged that the agency would remain committed to its core mission and invited market participants to share their views on how to reinforce the United States’ position as the most reliable place to do business.

A Shift in Enforcement Policy

The second part of the plan signals a return to closer cooperation with the industry. The regulator says it wants to restore enforcement to Congress’s original intent — targeting fraud and market manipulation instead of expanding its authority through isolated enforcement actions. The initiative also includes regular reviews of outdated rules and a broader overhaul of the agency’s administrative framework.

Technology and Efficiency

The third goal is modernization. Atkins plans to overhaul outdated systems such as EDGAR and transition to a more secure infrastructure. According to the proposal, the responsible use of artificial intelligence and blockchain technology will strengthen oversight while reducing operational costs.
